Indiapharma.com is committed to protecting the intellectual property rights of others and expects the same from its users. This policy outlines how we handle content uploads and address claims of infringement in compliance with Indian laws, including the Information Technology Act, 2000, and relevant intermediary liability guidelines.


1. User Responsibility and Content Ownership

By uploading content (product details, images, brochures, regulatory certificates, or any other materials) on Indiapharma.com, the user confirms that:

  • They are the owner of the content, or

  • They have obtained valid authorization from the rightful owner to upload, display, and promote such content.

  • The content does not violate any applicable copyright, trademark, or patent rights of any third party.

  • The content is factually accurate and not misleading, especially in the context of regulated pharmaceutical data.


2. Platform’s Role as an Intermediary

Indiapharma.com operates as an intermediary platform under the definitions of the Information Technology Act, 2000. As an intermediary, we do not control or endorse the content uploaded by users but are obligated to take appropriate action if notified of any infringing or unlawful content.


3. Infringement Claims and Notice Procedure

If you believe any listing on Indiapharma.com violates your intellectual property rights, you may send a formal Infringement Notice to our Grievance Officer at:

Include the following:

  • Your full name, designation, company name, and contact details

  • Clear description of the intellectual property allegedly infringed (e.g., patent number, trademark registration, copyright material)

  • The exact URL(s) of the content in question

  • Proof of ownership or authorized rights (license copy, registration certificate, etc.)

  • A signed declaration stating that the information provided is true and you are authorized to act on behalf of the rights holder


4. Action Upon Receiving Notice

Upon receiving a valid notice, Indiapharma.com will:

  • Acknowledge the complaint and initiate an internal review

  • Temporarily remove or restrict access to the allegedly infringing content within the statutory period (36 hours)

  • Notify the uploader and offer a chance to respond or submit proof of authorization

  • Restore or permanently remove content based on the resolution

  • Maintain records of such complaints and responses as per compliance norms


5. Repeat Infringement and Account Termination

Users found repeatedly violating intellectual property rights may have their accounts suspended or permanently terminated. Such action may be taken without prior notice depending on the severity of the violation.


6. Patent-Specific Disclaimers

Given the nature of pharmaceutical products, it is the sole responsibility of the uploader to ensure that no product listing infringes on existing patents in any applicable jurisdiction (India or global). Indiapharma.com does not verify patent status or exclusivity claims. Buyers are advised to conduct their own due diligence before proceeding with sourcing.


7. Indemnity

Users agree to indemnify and hold harmless Indiapharma.com and its parent company from any claims, losses, or damages arising due to intellectual property violations caused by their content.
